It's nonsense. You can give a bad reference if you choose. However, there is no upside to doing so and potential downsides if the employee decides the reference was unfair. So it's not in any company's interests to give a bad reference. Note that it's also possible to cause problems by giving a good reference, if the future employer decides it was unrealistic and that it caused them to offer a job to someone that turned out to be unsuitable. Thus many companies now have a policy of only giving a reference that gives a job title and confirms that a given individual worked for them between a given set of dates.
